Official Rules for the Rotary Club of Poipu Beach Vacation Raffle Sponsor: This random drawing game is sponsored by and is a fund raiser for Rotary Club of Poipu Beach Foundation (Sponsor), a non-profit organization. The funds generated by this random drawing game enable the Sponsor to fund scholarships and community organizations on the Island of Kauai. How To Enter: Tickets can be obtained until March 29th, 2010. Random drawing tickets are available for a $30 (USD) donation to RCPB Scholarship Fund via the internet, mail or club members. Eligibility: The random drawing game is open to any individual who is 21 years of age or older as of March 31, 2010. Winners agree to allow us to use your name and likeness in announcements or marketing publications, electronic or otherwise. You must also agree to allow your photo to appear on a "Winners" web page & other publications we deem appropriate. Prize: The winner can choose one of the following: Kauai Vacation Prize 7 nights at the luxurious Grand Hyatt Kaua’i (based on availability) at beautiful Poipu Beach Airfare for two from any US airport on a major commercial carrier with service to Hawaii Mid-size rental car $1000 for expenses $5000 Travel Certificate Prize $5000 Travel Certificate from Island Pacific Travel towards the cost of a travel vacation of your choice. Prize Restrictions: The following applies to the winner of each prize. All travel plans must be made at one time through Rotary Club of Poipu Beach or Island Pacific Travel. Winner who decides to travel and vacation in Kauai must select the Kauai Vacation Prize. Travel dates are subject to availability and holiday /blackout dates, conventions, and special event periods. All travel must be completed within 1 year of notification of winning. Not more than $1,000 in cash will be award to the winner. If winner is unable to travel by the date indicated, prize will be forfeited, and an alternate winner may be selected. Winners will be solely responsible for all other expenses not specifically set forth herein that are incurred by winner or any guest, including, without limitation, meals, gratuities, souvenirs, travel insurance, rental car insurance, and any other incidentals. Sponsor reserves the right, in its sole discretion, to substitute and or modify the prize with a prize of equal or greater value with immediate effect at any time prior to the closing date of the drawing by advertising that fact. All prizes claimed will be awarded. Prizes, reservations, and airline tickets are non-refundable, non-transferable, non-changeable once issued, and may not be used in conjunction with any other competition or offer. If lost, they will not be replaced. All tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. In addition, winner and guest(s) are responsible for any federal, state, and local tax consequences and for compliance with all governmental reporting and payment requirements. Unless otherwise expressly included in the specified prize. Winner Selection: Winners will be selected in a random drawing from all eligible entries received. Drawing will be held by Sponsor on or about March 31, 2010. All decisions in all matters made by The Sponsor relating to this random drawing are final. Odds of winning depend solely on the total number of valid tickets sold. Winner will be notified by e-mail or telephone. Ticket holders need not be present to win. If Sponsor, using commercially reasonable efforts, is unable to contact a potential winner within ten business days from the first contact attempt, or if a potential winner has not, or does not comply with these Official Rules, then such person shall be disqualified and an alternate winner may be selected. General Rules & Conditions: By participating in this drawing, entrants agree to be bound by these Official Rules. These Official Rules and all matters related to the random drawing will be governed by the laws of the State of Hawaii, without regard to its conflict of laws principles. Limitation of Liability: Sponsor, and its subsidiaries, affiliates, directors, officers, members, advertising and promotion agencies involved in this random drawing shall have no liability and shall be held harmless by entrant for any damage, loss or liability to person or property, due in whole or in part, directly or indirectly, by reason of participating in the random drawing, the acceptance, possession, use or misuse of any prize, or while preparing for, participating in, and/or traveling to and from any prize-related activity. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this random drawing, but in no event, attorney's fees. Sponsor is not responsible for technical problems, telephone failures, or fraud. Tampering: If for any reason the random drawing is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this drawing, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the game and/or prizes. In such event, Sponsor may award prizes in a random drawing from all eligible entries received up to the date of cancellation or suspension. Sponsor further reserves the right to disqualify any individual who tampers with or in any way corrupts the entry process. Sponsor may prohibit an entrant from participating in drawing or winning a prize if, in Sponsor's sole discretion, Sponsor determines that said entrant is attempting to undermine the legitimate operation of drawing by cheating, deception, or other unfair playing practices, or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
